The Government Accountability Office (GAO) has released an executive assessment examining mortgage trigger lead practices and the regulatory impact of the Homebuyers Privacy Protection Act. Trigger leads are generated when nationwide credit reporting agencies sell a homebuyer’s contact details and credit profile to third-party lenders immediately after an initial mortgage credit inquiry is filed. Prior to statutory intervention, credit bureaus could monetize and distribute this sensitive personal information without the consumer's explicit knowledge or consent, subjecting applicants to overwhelming volumes of targeted phone calls and automated text solicitations within hours of applying.

GAO’s analysis of the National Survey of Mortgage Originations revealed that the actual economic benefit of trigger leads for consumers is negligible. Data shows that no more than 3.5 percent of homebuyers ultimately secured a mortgage loan through competing offers generated by trigger leads. Industry stakeholders and consumer advocates highlighted several severe drawbacks, noting that high solicitation volumes confuse consumers, expose individuals to deceptive financial practices, and represent a clear compromise of personal data privacy. Furthermore, because buyers typically conduct rate comparisons prior to applying, post-application solicitations offer minimal utility while increasing risk.
